These Terms of Service ("Terms") govern your access to and use of the website located at https://www.carfia.com (including its subdomains and any related pages or applications, the "Site"), and the purchase of any products from the Site.
The Site is operated by CARFIA, a company organized under the laws of the Hong Kong Special Administrative Region of the People's Republic of China, with its principal place of business at KOALA INNOVATION CO., LIMITED NO. 6, 12/F, Wealth Commercial Centre, NO. 48 Kwong Wa Street, Kowloon, Hong Kong (together with its affiliates, "CARFIA", "we", "us" or "our").
These Terms consist of two parts, which together form a single, legally binding agreement (the "Agreement") between you and CARFIA:
- Part A — Terms of Use, which governs your use of the Site and its content; and
- Part B — Terms of Sale, which governs the purchase of products from the Site.
By accessing or using the Site, creating an account, placing an order, submitting content, or otherwise engaging with the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and by the following policies, each of which is incorporated into this Agreement by reference:

IMPORTANT NOTICE FOR CONSUMERS: Nothing in these Terms excludes, restricts, or modifies any right or remedy to which you are entitled under the consumer protection or other laws of your country of residence that cannot be excluded, restricted, or modified by agreement, including (where applicable) the Sale of Goods Ordinance (Cap. 26) and the Control of Exemption Clauses Ordinance (Cap. 71) of Hong Kong. If any provision of these Terms conflicts with such a non-excludable right, that right prevails to the extent of the conflict.
PART A — TERMS OF USE
1. Acceptance of and Changes to These Terms
1.1 By using the Site, you accept these Terms and agree to comply with them. If you do not agree, please do not use the Site.
1.2 We may revise and update these Terms and the Policies from time to time in our sole discretion. All changes are effective immediately when we post them on the Site, and apply to all access to and use of the Site thereafter. Where changes are material, we will take reasonable steps to bring them to your attention (for example, by updating the "Last Updated" date or displaying a notice on the Site).
1.3 Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page each time you access the Site so that you are aware of any changes.
2. Eligibility
2.1 The Site and the products offered on it are intended for individuals who are at least 18 years old (or the age of majority in their jurisdiction of residence, if higher) and who have the legal capacity to enter into binding contracts.
2.2 By using the Site or placing an order, you represent and warrant that you meet the foregoing eligibility requirements. If you do not, you must not use the Site or purchase products from us.
2.3 If we reasonably believe that you are using the Site or purchasing products for the purpose of resale or other commercial activity that is not expressly authorized by us, we may, in our sole discretion, reject your order, cancel your account, or restrict your access to the Site.
3. License to Use the Site and Restrictions
3.1 All content and materials on the Site, including without limitation text, graphics, images, photographs, illustrations, product descriptions, logos, button icons, software, audio and video clips, and the compilation, arrangement and display of such materials (collectively, "Content"), are the property of CARFIA, its licensors, or third-party content providers, and are protected by copyright, trademark, and other intellectual property laws.
3.2 We grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Site and to view, download, and print copies of the Content solely for your own personal, non-commercial use, and only to the extent necessary to browse the Site and purchase products from us. Except as expressly permitted in these Terms, you may not:
(a) copy, reproduce, republish, upload, post, transmit, distribute, sell, rent, lease, or license any Content in any form or by any means;
(b) modify, adapt, translate, create derivative works from, decompile, disassemble, or reverse engineer any part of the Site or Content;
(c) use any data mining, robots, scraping, or similar data gathering or extraction tools on the Site;
(d) frame, mirror, or otherwise incorporate any part of the Site into any other website or application;
(e) use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party's use of the Site; or
(f) attempt to gain unauthorized access to any part of the Site, the servers on which the Site is stored, or any account, computer, or database connected to the Site.
4. Ownership and Brand Protection
4.1 These Terms grant you only a limited license to use the Site and do not transfer to you any right, title, or interest in or to the Site or the Content. All rights not expressly granted to you are reserved by CARFIA and its licensors.
4.2 "CARFIA" and all related names, logos, product names, designs, and slogans are trademarks or registered trademarks of CARFIA or its licensors. You may not use any of them without our prior written permission, including without limitation as a domain name, account identifier, social media handle, or advertising keyword.
4.3 CARFIA's only official website is https://www.carfia.com. We do not operate, endorse, or accept responsibility for any other website that uses the CARFIA name, logo, or product images without authorization. Please be cautious of counterfeit or imitation sites, which may look similar to our Site. If you are unsure whether a website is operated by us, please contact our customer service team before making a purchase.
5. User-Generated Content and Community
5.1 The Site may allow you to submit, upload, post, or transmit reviews, comments, questions, photographs, "customer show" content, or other materials (collectively, "User Content").
5.2 You retain any rights you may have in your User Content. However, by submitting User Content, you grant CARFIA a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content, in whole or in part, in any media now known or later developed, for any purpose whatsoever, including without limitation marketing, advertising, and promotional purposes, without compensation to you. You further waive any moral rights or rights of attribution in your User Content to the extent permitted by applicable law.
5.3 You represent and warrant that: (a) you own or otherwise control all rights in and to your User Content; (b) your User Content does not infringe the intellectual property, privacy, publicity, or other rights of any third party; and (c) your User Content does not contain any unlawful, harassing, defamatory, obscene, or otherwise objectionable material.
5.4 User Content is provided on a non-confidential and non-proprietary basis. We are under no obligation to keep any User Content confidential, to compensate you for it, or to respond to it.
5.5 We have the right (but not the obligation) to remove, edit, or refuse to post any User Content in our sole discretion, including if we believe it violates these Terms. Where required by law, we may disclose your identity to any third party who claims that User Content posted by you infringes their rights.
6. Accounts
6.1 To place an order or use certain features of the Site, you may be required to create an account. You agree to provide accurate, current, and complete information and to update it promptly if it changes.
6.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
6.3 You may not sell, transfer, or assign your account or any account rights to any other person. We may suspend, disable, or terminate your account, in our sole discretion, if we suspect fraud, unauthorized use, or any violation of these Terms.
7. Product and Site Information Disclaimer
7.1 We make reasonable efforts to ensure that the information on the Site, including product descriptions, prices, and images, is accurate and up to date. However, we do not warrant that all such information is complete, accurate, or error-free, and we reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice, including after an order has been submitted (subject to Part B of these Terms).
7.2 By placing an order, you acknowledge and agree that:
(a) the colors and appearance of products as displayed on the Site may vary depending on your monitor, device, and lighting conditions;
(b) product images are for illustrative purposes only, and the written product description, dimensions, and specifications prevail in case of any discrepancy;
(c) certain products may be out of stock, discontinued, or subject to limited availability;
(d) any delivery or processing times shown on the Site are estimates only and are not guaranteed; and
(e) any online fit, try-on, or preview tools provided on the Site are for general guidance only and may not accurately represent the actual color, texture, size, or fit of the product on your face.
8. Intellectual Property Complaints
8.1 We respect the intellectual property rights of others and expect users of the Site to do the same. If you believe in good faith that any Content on the Site infringes your copyright or other intellectual property rights, please contact us at customer@carfia.com (please use the subject line "IP Notice") and provide: (a) a description of the work you claim is infringed; (b) the location of the allegedly infringing material on the Site; (c) your contact details; and (d) a statement that you believe in good faith that the use is not authorized. We will review and respond to such notices in a timely manner and may remove or disable access to the material at issue.
9. Privacy and Consent to Contact
9.1 Your use of the Site is subject to our Privacy Policy, which describes how we collect, use, disclose, and protect your personal information, including any location-based or device information we may collect to improve your shopping experience. By using the Site, you consent to the collection and use of your personal information as described in the Privacy Policy.
9.2 By providing your email address, phone number, or other contact details to us (including when placing an order or contacting our customer service team), you consent to receive service-related communications from us, such as order confirmations, shipping notifications, and customer service responses.
9.3 If you choose to receive them, we may send you promotional emails, WhatsApp messages, or other marketing communications about our products and offers. You may opt out of marketing communications at any time by following the unsubscribe instructions in the relevant message or by contacting us at customer@carfia.com. Please note that even after you opt out of marketing communications, you may continue to receive service-related messages necessary to fulfill your orders.

10.1 The Site may contain links to third-party websites, applications, or services (such as payment processors, installment-payment providers, shipping carriers, and social media platforms) that are not owned or controlled by us. We are not responsible for the content, policies, or practices of any third-party services, and we do not endorse them unless expressly stated.
10.2 Your use of any third-party service, including any payment method such as Klarna , is subject to that third party's own terms and privacy policy. We encourage you to review them before using such services. We disclaim all liability arising from or related to your use of third-party services.
11. Availability, Suspension, and Termination
11.1 We do not guarantee that the Site, or any feature of it, will be available at all times or without interruption. We may, in our sole discretion and without notice or liability, temporarily or permanently suspend, terminate, or restrict access to all or part of the Site, or to your account, for any reason, including scheduled maintenance, security incidents, or violation of these Terms.
11.2 These Terms remain in effect for as long as you use the Site. You may stop using the Site at any time. Upon termination, the provisions of these Terms that by their nature are intended to survive, including Sections 3, 4, 5, 6, 9, 12, 13, 14, 15, and 16 of Part A, will continue in full force and effect.
12. Disclaimer of Warranties
12.1 To the maximum extent permitted by applicable law, the Site and all Content are provided on an "AS IS" and "AS AVAILABLE" basis, "WITH ALL FAULTS", and without any representations, warranties, or conditions of any kind, whether express or implied, statutory, or otherwise, including without limitation implied warranties of merchantability, fitness for a particular purpose, title, accuracy, non-infringement, and warranties arising from course of dealing or usage of trade.
12.2 We do not warrant that the Site will be secure, uninterrupted, or error-free, that defects will be corrected, or that the Site or the servers that make it available are free of viruses or other harmful components. Any reliance on the Site or the Content is at your own risk.
13. Health and Eyewear Disclaimer
13.1 The Site may contain general information about eyewear, vision, UV protection, and eye health. Such information is provided for general educational purposes only and is not intended to diagnose, treat, cure, or prevent any medical or vision condition, and does not constitute professional medical or optometric advice.
13.2 Sunglasses and optical products sold on the Site are not medical devices and are not a substitute for a professional eye examination or the advice of a licensed optometrist, ophthalmologist, or other qualified healthcare professional. If you have a vision condition, require prescription lenses, or have any concerns about your eye health, please consult a qualified professional before using our products.
14. Limitation of Liability
14.1 To the maximum extent permitted by applicable law, in no event will CARFIA, its affiliates, and their respective officers, directors, employees, agents, successors, and assigns be liable to you or any third party for any indirect, incidental, special, punitive, exemplary, or consequential damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of (or inability to use) the Site, the Content, or any products purchased from us, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
14.2 To the maximum extent permitted by applicable law, our total aggregate liability to you arising out of or in connection with these Terms, the Site, or any order or purchase, whether in contract, tort (including negligence), or otherwise, will not exceed the total amount actually paid by you to us for the products or services that are the subject of the relevant claim.
14.3 Nothing in this Section 14 limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.
15. Indemnification
15.1 To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless CARFIA, its affiliates, and their respective officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Site or any products purchased from us; (b) your User Content; (c) your breach of these Terms; or (d) your violation of any law or the rights of any third party.
16. Governing Law and Dispute Resolution
16.1 These Terms and any dispute or claim arising out of or in connection with them, the Site, or any purchase (including non-contractual disputes or claims) will be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict-of-law rules.
16.2 Before initiating any proceeding, you and we agree to make a good-faith effort to resolve any dispute informally by contacting the other party (you may contact us at customer@carfia.com). If the dispute is not resolved within thirty (30) days of the initial contact, either party may refer the matter to the courts of Hong Kong.
16.3 Subject to Section 16.4, the courts of Hong Kong will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
16.4 If you are a consumer residing outside Hong Kong, nothing in this Section 16 deprives you of the protection of the mandatory laws of your country of residence, and you may also bring proceedings in the courts of that country where such laws so provide. Nothing in these Terms limits any right you may have under applicable consumer protection law to have a dispute heard in a forum of your choosing where such right cannot be waived by agreement.
17. Waiver and Severability
17.1 Our failure or delay in exercising any right or provision of these Terms will not constitute a waiver of such right or provision, and no waiver of any term will be effective unless it is in writing and signed by us.
17.2 If any provision of these Terms is held by a court or other competent authority to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect and enforceable.
18. Entire Agreement, Assignment, Headings, and Language
18.1 These Terms, together with the Policies and any other terms expressly referenced herein, constitute the entire agreement between you and CARFIA regarding your use of the Site and the purchase of products, and supersede all prior or contemporaneous communications, representations, and agreements, whether written or oral.
18.2 We may assign, transfer, or subcontract any of our rights or obligations under these Terms without notice to you. You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent.
18.3 The headings in these Terms are for convenience only and have no legal or contractual effect.
18.4 If these Terms are translated into languages other than English for convenience, the English version will prevail in the event of any conflict or discrepancy.

PART B — TERMS OF SALE
1. Products and Ordering
1.1 Part B of these Terms applies to all products offered for sale on the Site, including sunglasses, optical (eyeglass) frames and lenses, and related accessories (collectively, "Products"), as described on the relevant product pages.
1.2 Each order you place on the Site constitutes an offer to purchase the Products in your order. An order containing multiple items constitutes multiple separate offers. We may accept or decline any offer at any time prior to confirmation, as set out in Section 3 below.
1.3 Once you have received an order confirmation (on the Site and by email), we may not be able to add to, modify, or combine your order. If you wish to modify or cancel an order, please contact our customer service team at customer@carfia.com as soon as possible. Orders may generally be modified or cancelled free of charge within twenty-four (24) hours of placement; modification or cancellation requests received after that time may be subject to the handling fees described in our Returns, Exchange & Refund Policy.
2. Your Representations
2.1 By placing an order, you represent and warrant that: (a) you are at least 18 years old (or the age of majority in your jurisdiction, if higher) and have the legal capacity to enter into binding contracts; (b) the information you provide in connection with your order is true, accurate, current, and complete; and (c) if you are purchasing prescription eyewear, you will comply with Section 5 of Part B.
3. Order Acceptance and Rejection
3.1 We reserve the right, in our sole discretion, to refuse or cancel any order at any time. Without limiting the foregoing, we may reject or cancel an order, and refund any amount paid, where:
(a) the Products are out of stock or otherwise unavailable;
(b) we identify an error in the price or description of the Products;
(c) the order or payment information cannot be verified or appears to be incorrect;
(d) the order is flagged by our security or fraud-prevention systems as suspicious, fraudulent, or unlawful;
(e) we have reason to believe that the order is placed for resale or other unauthorized commercial purposes; or
(f) we are unable to deliver to the address you provided.
3.2 Where an order is rejected or cancelled after payment has been processed, we will refund the amount paid for the cancelled Products to the original payment method without undue delay, in accordance with Section 7.3 below.
4. Prices, Taxes, and Payment
4.1 All prices for Products are displayed on the Site in the currency shown at checkout and are quoted excluding applicable taxes, shipping, and other charges unless expressly stated otherwise. We make reasonable efforts to ensure prices are accurate, but errors may occur. If we discover an error in the price of a Product you have ordered before we confirm the order, we will inform you and give you the option to reconfirm the order at the correct price or cancel it with a full refund.
4.2 Any applicable sales, value-added, or similar taxes, and any shipping and handling charges, will be added to your total at checkout and are described in more detail in our Shipping Policy.
4.3 Payment is due at the time you place your order. We accept the payment methods displayed at checkout, which may include major credit and debit cards (such as Visa, Mastercard, and American Express), PayPal, and installment-payment providers such as Klarna . Your payment information is processed securely, and we do not store full card details on our servers.
4.4 Where you choose a payment method provided by a third party (including installment or "buy now, pay later" services), your use of that service is governed by that third party's own terms and privacy policy, and payment obligations to that provider are governed accordingly.
4.5 Where an order is split into multiple shipments, we will charge you only for the items that have actually been shipped at the time of each charge.
5. Prescription Eyewear (If Applicable)
5.1 If you order prescription lenses from the Site, you represent and warrant that you are not legally blind or severely visually impaired, and that you hold a valid, unexpired prescription issued within the last twenty-four (24) months by a qualified eye care professional, authorizing the lenses you order.
5.2 You agree that we (or our lens laboratory) may contact your prescribing eye care professional to verify your prescription, and that we may require you to provide your pupillary distance (PD) measurement or a new written prescription where reasonably necessary. We cannot process prescription orders without a valid prescription and may refuse orders that cannot be verified.
5.3 You acknowledge that incorrect or incomplete prescription information may result in incorrect lenses, and that you are responsible for the accuracy of the prescription and measurements you provide.
5.4 If you do not offer prescription eyewear on your Site, this Section may be disregarded at your discretion.
6. Shipping, Delivery, and Risk of Loss
6.1 All Products are delivered in accordance with our Shipping Policy, which forms part of these Terms. Shipping costs, free-shipping thresholds, and estimated delivery times are set out in the Shipping Policy and at checkout.
6.2 Unless otherwise stated in the Shipping Policy, Products are delivered under a shipment contract. This means that the risk of loss and title to the Products pass to you upon our delivery of the Products to the carrier, and you are responsible for filing any claims with the carrier for loss or damage occurring during shipment. However, if Products arrive damaged or defective, please contact our customer service team and we will assist you in accordance with Section 7 below.
6.3 Any estimated processing or delivery dates shown on the Site are estimates only and are not guaranteed. We will not be liable for any delay caused by events beyond our reasonable control (see Section 8 below).
6.4 Import duties, customs fees, and taxes (if any) that arise in connection with the import of Products into your country will be handled as described in our Shipping Policy. It is your responsibility to check the Shipping Policy for whether such charges are included in the price of your order.
7. Returns, Exchanges, Refunds, and Warranty
7.1 Our returns, exchange, and refund practices are governed by this Section 7 and by our Returns, Exchange & Refund Policy, which forms part of these Terms.
7.2 14-Day Fit & Style Guarantee. If you are not completely satisfied with your purchase, you may request a one-time, no-questions-asked exchange or refund within fourteen (14) days of receiving your order (subject to the conditions in the Returns, Exchange & Refund Policy). Unless the return is due to a manufacturing defect or our error, return shipping and processing fees may apply and will be deducted from any refund or charged to you as described in the Returns, Exchange & Refund Policy. Products must be returned in their original condition, with all labels, packaging, documentation, and accessories, and must not have been damaged by accident, negligence, or improper care.
7.3 Refunds. Refunds will be issued to the original payment method after we receive and inspect your returned Products, or, where applicable, after you provide tracking information as described in the Returns, Exchange & Refund Policy. Refund processing times depend on your payment method: credit/debit card refunds may take up to thirty (30) days to appear on your statement (in most cases approximately one (1) week, depending on your bank's processing times); PayPal refunds are generally processed within three (3) business days. We will not obtain ownership of returned Products until the return arrives at our fulfillment center.
7.4 Warranty. Without limiting your statutory rights, Products are covered against defects in materials and workmanship for a period of 1 year from the date of receipt, as described in the Returns, Exchange & Refund Policy. If a Product is defective or does not conform to its description, you may return it to us free of charge in accordance with the Returns, Exchange & Refund Policy, and we will, at our option, repair, replace, or refund the Product. The warranty does not cover damage caused by accidents, negligence, improper care, normal wear and tear, or unauthorized modification.
7.5 Conditions and Abuse. We may reject returns or cancel purchases where: (a) the Products are not returned in their original condition; (b) the purchase data is incorrect or cannot be verified; (c) the order is flagged as fraudulent or unlawful; (d) we have reason to believe the purchase was made for resale or other commercial purposes; or (e) we reasonably believe the return is abusive, fraudulent, or in bad faith, including through repeated abuse of the Fit & Style Guarantee.
7.6 Statutory Rights. This Section 7 does not affect any rights you may have under the consumer protection laws of your country of residence, including the right to return defective or non-conforming Products.
8. Force Majeure
8.1 We will not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from events beyond our reasonable control, including without limitation fire, flood, earthquake, storm, other natural disasters, acts of God, war, civil unrest, terrorism, epidemics or pandemics, government actions, power failures, internet or telecommunications outages, labor disputes, or carrier delays.
9. Product Warranties and Disclaimers
9.1 To the maximum extent permitted by applicable law, and except for the warranty expressly set out in Section 7.4 above and in the Returns, Exchange & Refund Policy, the Products are provided and sold on an "AS IS" and "AS AVAILABLE" basis without any express or implied warranties, including without limitation implied warranties of merchantability or fitness for a particular purpose.
9.2 We do not warrant that the Products will match your expectations as to style, comfort, or appearance, except as expressly provided in the 14-Day Fit & Style Guarantee in Section 7.2.
10. Limitation of Liability
10.1 To the maximum extent permitted by applicable law, CARFIA's liability in connection with the Products and any order is subject to the limitations set out in Section 14 of Part A, which apply to Part B as if fully set out herein.
11. Governing Law and Dispute Resolution
11.1 The governing law and dispute resolution provisions set out in Section 16 of Part A apply to Part B as if fully set out herein.
